Studio Membership Agreement + Liability Waiver 

This Studio Membership Agreement (“Agreement”) is entered into between Mojo Glassworks LLC / Mojo Glassworks (“Studio”) and the undersigned member (“Member”).

By signing below, Member agrees to all terms and conditions in this Agreement.

1) MEMBERSHIP BENEFITS AND INCLUDED ACCESS

1.1 Membership Plan

- 15 hours of bookable Studio time per month

- Use of Studio tools and equipment, including: hand tools, grinders, ring saw

1.2 Membership Perks

- 10% discount on Wissmach, Youghiogheny, and Kokomo glass

- 10% discount on foil, lead, patina, polish, cutting oil

- 20% off fusing fees

- Access to purchase frit by the ounce

- Access to quarterly Members Social Event(s) (dates and format at Studio discretion)

1.3 Membership Does NOT Include Consumable Supplies

Membership does not include and Member is responsible for purchasing: glass sheets; solder; foil; came/lead; chemicals; polish; patina; adhesives; flux; cutting oil; PPE (unless provided as courtesy); and other consumable supplies as determined by Studio.

Member acknowledges and agrees that Studio may modify what is considered “consumable” at any time as needed for inventory control and safety.

2) STARTUP FEE + ORIENTATION REQUIREMENT

2.1 Orientation Fee

A $35 Startup Fee is required for all new members and includes safety orientation, equipment overview, studio rules + cleanup expectations, and tool approval (as applicable).

2.2 No Independent Studio Use Until Orientation Completed

Member may not Studio independently until Studio has completed Member orientation and confirmed tool permissions.

3) BOOKING, HOURS, AND ATTENDANCE

3.1 Booking Required

Studio use requires booking/reservation through Studio scheduling procedures.

3.2 Monthly Hours

Membership includes 15 hours/month. Hours do not roll over, are not transferrable, and may not be shared with others unless Studio explicitly approves in writing.

3.3 Studio Rules + Conduct

Studio reserves the right to cap attendance, modify open studio hours, modify booking policies, and refuse service to any individual for safety or misconduct.

4) STORAGE ADD-ON TERMS (OPTIONAL)

Storage is available in 1-month increments only and may be canceled at any time.

4.1 Storage Options

- Flat File Storage – 24” x 24”, projects only, no tool storage — $25/month

- Shelf Bin Storage – Member supplies bin 20”x 24”x12” with lid — $50/month

4.2 No Storage Without Active Membership

Storage is available only to active members. If membership ends, storage must be removed as outlined below.

4.3 Storage Is At Member’s Risk (Important Fine Print)

Member acknowledges and agrees Studio is not responsible for loss, theft, damage, fire, water damage, contamination, breakage, or deterioration of Member property stored on-site. Studio does not insure Member items. Member stores items entirely at their own risk.

Member is responsible for labeling all items clearly.

5) ABANDONED PROPERTY POLICY

5.1 Abandoned Items

Any personal items, tools, materials, or projects left behind are considered abandoned if Member has no active membership; storage fee is unpaid; and/or items are left in studio areas not designated for storage.

5.2 Removal After 30 Days

Studio may remove and dispose of any abandoned items after 30 days, without refund or liability, including donating or discarding materials. Member acknowledges stained glass projects may be fragile and Studio is not liable for breakage during removal.

6) TOOL USE, DAMAGE, AND REPAIR

6.1 Proper Tool Use Required

Member agrees to use tools safely and only as trained/approved.

6.2 Damage

If Member damages Studio tools, equipment, furniture, grinders, ring saws, ventilation systems, or other property due to misuse or negligence, Studio may charge Member for repair costs, replacement costs, and labor time. Studio reserves the right to revoke tool privileges for misuse.

7) SAFETY ACKNOWLEDGMENT AND LIABILITY WAIVER

Stained glass work involves inherent risks including but not limited to: cuts, punctures, scrapes from glass and metal; burns from soldering irons/hot surfaces; eye injuries; exposure to chemicals and fumes; repetitive strain injury; slips/falls; allergic reactions; and respiratory irritation.

7.1 Member Safety Responsibilities

Member agrees to follow all posted safety rules; use PPE (eye protection strongly recommended at all times); comply with ventilation and chemical handling rules; immediately report injuries or safety hazards; and maintain a clean workspace and dispose of sharp waste properly.

7.2 Waiver of Liability (Very Important)

To the fullest extent permitted by law, Member assumes all risks of participation and releases and holds harmless Studio, its owners, employees, contractors, volunteers, landlords, and affiliates from any and all claims, liabilities, damages, injuries, or losses arising out of or related to use of Studio space; use of Studio tools/equipment; participation in Open Studio; storage of personal property; and events or social gatherings.

This waiver includes claims arising from ordinary negligence but does not include gross negligence or willful misconduct where prohibited by law.

8) MEDICAL TREATMENT AUTHORIZATION

If Member is injured and unable to provide consent, Member authorizes Studio to contact emergency services, contact the emergency contact listed above, and provide basic first aid assistance. Member is financially responsible for all medical costs.

9) PHOTO/VIDEO RELEASE

By agreeing to the terms and conditions, permission is granted for the studio to use member’s likeness in Studio marketing.

10) PAYMENT, CANCELLATION, AND TERMINATION

10.1 Monthly Billing

Membership is billed monthly.

10.2 No Refunds

All membership fees and storage fees are non-refundable once billed.

10.3 Cancellation

Member may cancel before the next billing cycle to avoid renewal.

10.4 Studio Termination

Studio may terminate membership immediately for unsafe actions, harassment or disruptive behavior, repeated cleanup violations, or violation of Studio policies. Termination is at the sole discretion of the Studio. Termination does not create any obligation for refund.

11) Membership Terms Change Clause (30-Day Notice)

Studio Right to Modify Pricing and Terms

Mojo Glassworks reserves the right to modify membership pricing, benefits, policies, studio rules, storage rates, open studio scheduling procedures, and/or any other terms of membership at any time.

For existing members, any material change to membership pricing or terms will be provided with at least thirty (30) days’ notice prior to taking effect. Notice may be delivered via email, written notice in the studio, and/or by posting updated terms on the Mojo Glassworks website.

Continued membership participation and/or continued payment after the effective date of the changes constitutes acceptance of the updated pricing and/or terms.

12) GENERAL LEGAL TERMS

12.1 Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia.

12.2 Severability

If any portion is unenforceable, remaining portions remain valid.

12.3 Entire Agreement

This document is the entire agreement and supersedes prior discussions.

For most classes:

You will be issued a full refund (minus a 3% merchant services fee on credit card payments) if you cancel at least 7 days before the class.

If you cancel within 7 days of the class, we will issue a refund only if we are able to fill your spot.

The 7 day window also applies when rescheduling into another class.

For classes priced at $250 or more:

You will be issued a full refund (minus a 3% merchant services fee on credit card payments) if you cancel at least 14 days before the class.

If you cancel within 14 days of the class, we will issue a refund only if we are able to fill your spot.

The 14 day window also applies when rescheduling into another class.
